This is the Terms of Use of Maleena (“Maleena” or “Website” or “We” or “Us”). The terms and conditions mentioned here within are applicable to this site and all its subsidiaries, divisions and affiliates that operate with the site and in any way reference with these terms and conditions.

By using the site, users consent complete understanding of these terms and conditions and in case someone does not agree please refrain from using the site. The site at all times reserves the rights to modify, add, change or remove any portion of the Terms and Conditions. Any such condition will come in affect immediately after being posted on the site without the issuing of any other notice. It is advised that users regularly check these Terms and Conditions to stay updated continued use of the site after any changes in the Terms and Conditions state acceptance of them by the users.

Site’s Usage

The Maleena should be used by individuals over the age of 18 or at least under the supervision of someone over that age (parent or legal guardian). We grant all users a revocable and non transferable license to use the site and its features, under defined Terms and Conditions, for personal items shopping purpose from the site. We prohibit using the site for a third party or for any commercial purpose except if its permission has been granted by us in advance to the user. Breach of any Terms and Conditions will result in immediate effective revocation of the granted license stated above without issuing any prior notice to the user.

The contents available on the site are intended for information purpose only and all products represented on the site belong to their sellers, vendors and are not our personal products. Also all opinions and submissions present on the site are postings by individuals visiting the site and does not in any way represent our opinion.

Certain features available on the site may require users to register themselves or seek subscription prior to their use. If a user decides to subscribe or register themselves, they agree to provide all current and accurate personal information and to immediately update the information lest any changes are made. All users of the site are self responsible for protecting the passwords and other identifiers of their accounts secure and safe and will be held responsible for any activity that results in compromising of any personal access details and passwords. The site is in no way responsible or liable in any indirect or direct manner, for any damage or loss that is incurred owing to compromising of account identifiers and passwords of any customer or member. We are also not liable for any damage or loss that incur in connection, as a result or in case of failure in complying with this particular section.

During the process of registration members agree to subscribe to promotional emails from the site. However, users can at any time decide to opt out of this subscription simply by clicking the “Unsubscribe” button available in every promotional e-mail.

Submissions by Users

Everything users provide us on the site inclusive of though not limited to reviews, questions, comments, suggestions, products listings etc. will automatically become our property and will not in any way be returned to user. Also owing to the applicable rights that a user surrenders to on any submission of comments, content or review, the site receives the rights to post your name as submitted by you. Users are prohibited to use any false emails or addresses or pretend to be someone who they are not, or any other such act that misleads the site or any other third party to your origins of submission. We may /shall be obligated to edit or remove any such user submission.

User Code of Conduct

You agree to use the Website and the Service only to post and upload product listings material that is proper. By way of example, and not as a limitation, you agree and undertake that when using a Service, you will not:

– Abuse, defame, harass, stalk, threaten or otherwise violate the legal rights of others

– Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, indecent or unlawful topic, product listing, material or information

– Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents

– Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another’s computer

– Conduct or forward surveys, contests, pyramid schemes or chain letters – Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner

– Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded

– Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service

– Violate any applicable laws or regulations for the time being in force in or outside Pakistan; and violate any of the terms and conditions of this Agreement or any other terms and conditions for the use of the Website contained elsewhere herein.

Pricing and Order Acceptance

It is important to know that all prices and products listed at Maleena are offered by different sellers and you are making orders with appropriate seller of that particular product. In some cases processing an order may not be possible. The site therefore attains the rights to refuse or cancel any order, anytime. Users may be asked to provide information in addition to the basic requirements in form of order posting and verifications, and other information inclusive of though not limited to address and phone number, before an order is accepted and that information will be directly shared with appropriate seller.

This process of order verification can take face of checking contact number, delivery address or identity. In case response of this inquiry is not received, this will lead to automatic cancellation of the order placed within a time period of two days.

We thrive to offer the best pricing to users of the site. However, possibilities of error exist related to price occurs such as in case where price is inaccurately mentioned. In such a case the Website or sellers reserves the right to refuse or cancel any such order. In case where a price is inaccurately mentioned, the Website at its own discretion will consult the user for further instruction or of the cancellation of order. The user will be notifies of any such action taken. The site reserves the right to cancel and/or refuse any such order irrespective of whether the user has already been confirmed of its purchase.

Copyright and Trademarks

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, respective brand owners in most cases and Maleena in some cases, owns certain Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, titles and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, articles, trade secrets and inventions (whether patentable or not), goodwill, source code, databases, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to Maleena without obtaining authorization from us.

Notwithstanding the foregoing, it is expressly clarified that you will retain ownership and shall solely be responsible for any content that you provide or upload when using any Service, including any text, data, information, images, photographs, music, sound, video or any other material which you may upload, transmit or store when making use of our various Service. However, with regard to the product customization Service (as against other Services like blogs and forums) you expressly agree that by uploading and posting content on to the Website for public viewing and reproduction/use of your content by third party users, you accept the User whereby you grant a non-exclusive license for the use of the same.

Arbitrations Terms

Any difference, controversies, disputes that arise in lieu of interpretation, implementation or performance of the stated Terms and Conditions shall be settled finally through the process of arbitration by assigning a single arbitrator in accordance with the Chartered Institute of Arbitrators. The arbitrator should be trained legally and should be apt in the information technology field and completely independent of both parties. The arbitration process language will be English and the award of arbitrator shall be binding and final and can be entered in any competent jurisdiction court and enforced based on the Arbitration Act 1995 No. 4. Notwithstanding the foregoing, the rights are reserved by the site to track intellectual property rights protection and confidential information through equitable or injunctive relief through courts that are competent.

Fees & Service Charges

Maleena is an online shopping platform that connects end-users seller and buyer to buy and sell online. Basic registration and listing of products on the Website is totally free. However, Maleena applies “Sale Commision” to all sellers upon generating every successful sales, and special fees for add-on or special promotional services agreed with the sellers.

Before listing an item for Sale/Promotion through the Website, we request you to review the Commision Structure that you will be charged based on your products and categories ranging from 2% to 15%. Maleena.pk may amend the Commision Structure anytime and will communicate to all the sellers in 15 days in advance.

All fees shall be quoted in PKR (Pakistani Rupees). You must pay all commision fees due and payable to Maleena.pk (and any applicable taxes or charges) within 7 days of the date of the invoice generation with a valid payment method.

Maleena commision fees charging cycle is monthly. Upon completion of every month, we’ll send you a statement till 5th of the month and you have to verify all the sales and commision within 3 days of receiving of our email and notify us about unconfirmed, junk or cancelled items. All Sale Commisions against confirmed Sales should be made between 12th and 15th of the month. Sellers who will not pay the Sale Commision and/or any applicable taxes and charges by Seller to Maleena.pk within 20th days from the date of statement, we may reserves the right to:

– Issue you with a warning regarding the non-payment in question

– Temporarily or indefinitely suspend, limit or remove your access to the Website and/or your registration

– delisted or removed from Maleena

– Impose restrictions on the number of product listings that the Seller may post.

Terms of Termination

In addition to equitable and legal remedies, the site reserves the right, without any prior notification to instantly terminate these Terms and Conditions or cancel any of user’s rights that are granted under the same. In case of termination of the existing agreement, users shall instantly cease use and all access to Website in addition to any other equitable or legal remedies, cancelling all passwords and other account identifications that were previously issued to user, completely denying all use and access to Website in part or in whole. Any such termination however will not affect any respective obligations and rights, inclusive of payment obligations and without limitations, of any party that arose before termination date. User shall also agree that the Website is not in any way liable to the user or any other individual for results occurring owing to termination or suspension. In case any user is dissatisfied with any conditions, terms, policies, rules, guidelines, practices or the site of Maleena as a whole, the exclusive and sole remedy in such a case is to discontinue Website’s use.
